TERMS AND CONDITIONS

Please ensure you read these ‘Terms & Conditions’ carefully as payment of the deposit is deemed as having read and agreed to the Terms & Conditions stated below. 


1. DEFINITIONS

In this Agreement, the following definitions shall apply unless the context does not permit it:

Agreement means the agreement formed by the Terms & Conditions.

Bridal Package means ala-carte gown rental or bundle deal with makeup, photography and/or videography services provided by other Vendor(s).

Client means the person identified in the Order as the purchaser of the Bridal Package(s).

Deposit means an amount equal to fifty percent (50%) of the total package fees.

Effective Date means the date on which this Agreement is entered into by both Parties.

In Writing means communications by post, text messaging and/or email.

Online Payment means payment by any one or more of the following payment modes as may be designated by WeddingCrafters from time to time. These include PayNow, PayLah, online banking and other designated payment modes.

Online Store means the WeddingCrafters’ online store currently accessible at https://weddingcrafters.com.sg.

Order means an online order placed via the Online Store by a Client for the Bridal Package(s) in accordance with these Terms & Conditions.

Parties mean WeddingCrafters and the Client. Party means any one of them.

Payment Processing Company means the applicable payment or card processing entity for the relevant Online Payment mode.

Product(s) means gown(s) and/or Bridal Package(s) provided by WeddingCrafters

Service(s) include, but not limited to, gown consultation sessions, fitting sessions and/or alteration works.

Vendor(s) means third parties that are advertised on or available at the Site.


The words “include” and “including” shall not be understood as having any limiting effects.


2. GOWNS

2.1 Client has the flexibility to choose from the full range of gowns (including current and all upcoming collections up to 2 months before date of usage), and alterations will be done within the limits of the existing gown(s).

2.2 Client has the flexibility to change gown design choice(s) with each new collection, up to 2 months before date of usage, as long as the gown is available.

2.3 Prices include 2-3 rounds of fittings and size alterations, as well as complimentary rental of accompanying accessories such as bridal veil and/or petticoat. 

2.4 Availability of the preferred gown(s) will be based on a first-come-first-book basis. Soft booking of gown(s) is only allowed upon receipt of the initial Deposit.

2.5 For re-ordering of existing gown design in a different size, WeddingCrafters do not guarantee a full 100% similarity to the original piece as this is subject to lace and fabric availability at time of order.

2.6 Clients who require an additional Kua rental on top of existing Bridal Package inclusions, this is chargeable at $180 per kua. For rental of kuas, Client shall choose from existing designs / sizes. No alteration services are provided. 


3. BRIDAL PACKAGES

3.1 Once Deposit is made for any Bridal Package(s), no downgrades are allowed.

3.2 All payments made by the Client to WeddingCrafters are non-refundable and non-transferable.

3.3 Complimentary Pre-Wedding Kit must be booked in advance – items within the kit are subject to availability.

3.4 WeddingCrafters does not, in any event, warrant, guarantee, or assume responsibility for any material, product or service by a Vendor and the Company shall not be liable for any failure, delay or default on the part of any Vendor. 

3.5 In the event of any dispute, claim, question or disagreement, WeddingCrafters shall make reasonable efforts to resolve the dispute(s) through mediation between the Client and the Vendor in accordance with the mediation rules of the Singapore Mediation Centre. 

3.6 All services fulfilled by the Vendor(s) are subject to their respective set of terms and conditions. 


4. FEES AND PAYMENT

4.1 A 50% Deposit is required upon confirmation for all Bridal Package(s). 

4.2 If the Client has multiple events, the next 25% is due 24 hours before the gown(s) collection for the first event usage (for e.g. pre-wedding/ROM) and the balance 25% payment is due 24 hours before the collection for the final event usage (for e.g. Actual Wedding Day). If the Client only has 1 event, the 50% balance payment is due 24 hours before the gown(s) collection.

4.3 All prices indicated are nett.

4.4 All Online Payments are subject to processing by WeddingCrafters’ payment service provider, the approval of the Payment Processing Company and the relevant issuing bank. WeddingCrafters shall not be liable in any way if the payment service provider, Payment Processing Company or the issuing bank refuses to process or accept any Online Payment particulars for any reason. 

4.5 The Client agrees to submit to WeddingCrafters, and its payment service provider, Online Payment or card information and other personal and delivery information that may be reasonably requested by WeddingCrafters or its payment service provider to process the Order, payment for the Order, and invoicing. All information submitted shall be subject to WeddingCrafters’ Privacy, Cookies and Data Protection Policy. WeddingCrafters shall require its payment service provider to keep such information confidential and not use the same for any purpose other than to carry out its service. The Client agrees that WeddingCrafters shall not be liable for any loss, damage, or liability in the event of any unauthorised disclosure of such information by its payment service provider. 

4.6 WeddingCrafters reserves the right to exercise its lawful remedies if a dispute or issue arises over Online Payments, or if it does not receive full payment for an Order. In particular, but without limitation to any other remedies, if the Payment Processing Company or the issuing bank rejects or reverses payment for an Order, WeddingCrafters may in its discretion cancel the Order and/or refuse to accept future Orders from the Client.


5. FITTINGS AND ALTERATIONS

5.1 Client agrees and undertakes as follows: 

(a) to provide feedback on fittings/alterations as and when required by WeddingCrafters; 

(b) to ensure shoes worn during the fitting sessions are the ones intended to be worn on the pre-wedding/wedding day;

(c) to ensure lingerie/corset worn during the fitting sessions are the ones intended to be worn on the pre-wedding/wedding day;


6. RENTAL PERIOD

6.1 Rental period for each gown may be up to a total of 5 consecutive days (inclusive of the day of collection & return). WeddingCrafters reserves the right to request for an earlier return of the rental gown(s), if required during the peak wedding season. This will be communicated beforehand to the Client.

6.2 All collections/returns will be done at the WeddingCrafters’ premises. Appointments are to be made in advance for collections/returns.

6.3 WeddingCrafters will use their best efforts to ensure the gown(s) are provided clean and in a wearable condition. The Client shall notify WeddingCrafters of any damage or discrepancy within 24 hours of collection. Failure to notify WeddingCrafters within that time period means that the Client has accepted the gown(s) in the quantity, quality and condition in which they were received.

6.4 All rental gowns should be returned within 5 days from date of collection. A late return penalty fee will apply after the fifth day.

6.5. If the Client wishes to extend the rental period, the Client shall inform WeddingCrafters (min. 3 months in advance) and will be charged a fee prorated against the total gown rental fees. 

6.6 The Client is liable for all loss or damage caused to the gown(s). The client shall inform WeddingCrafters In Writing of any loss of or damage to the gown(s). In the case of damage, WeddingCrafters will assess the damage and deduct a fee from the security deposit in order to account for repair costs. In the case of loss of gown(s) and/or extensive and irreparable damage, the Client is liable to forego the entire security deposit. 

6.7 The Client shall not arrange dry cleaning for the gown(s).

6.8 The Client shall not alter or modify the gown(s) in any way.


7. SECURITY DEPOSIT

7.1 The Client shall pay a security deposit of SGD 800 before collection – this will be refunded in full once the gown(s) is/are returned in its original condition within the stated rental period. Should there be anything else owed to WeddingCrafters (e.g. extension of rental period, late returns or damage to and replacement of gown(s), etc.), WeddingCrafters reserves the right to deduct from this deposit.


8. PROMOTIONS

8.1 Same-day promo is only valid for first-time customers who choose to sign up during their 1st appointment at the studio. A standard 50% Deposit will be required upon sign-up/confirmation. Complimentary item is strictly not exchangeable for cash or other item(s) not stated in the promo. Complimentary item will be dependent on stock availability on a first-come-first-served basis. WeddingCrafters reserves the right to substitute any of the perks in the event of insufficient inventory. Not valid in conjunction with other promotions.

8.2 Same-week promo is only valid for first-time customers who choose to sign up within 7 days of their 1st appointment at the studio. A standard 50% Deposit will be required upon sign-up/confirmation. Complimentary item is strictly not exchangeable for cash or other item(s) not stated in the promo. Complimentary item will be dependent on stock availability on a first-come-first-served basis. WeddingCrafters reserves the right to substitute any of the perks in the event of insufficient inventory. Not valid in conjunction with other promotions.

8.3. No promotion, offer, voucher, or online store credit will be applied retroactively to any standing or previously placed Order. Any applicable promotions, offers, vouchers, or online store credit must be stated before making payment as these cannot be claimed or applied after an Order have been made. No promotion, offer, voucher, or online store credit may be exchanged for cash.


9. POSTPONEMENTS / COVID-19

9.1 WeddingCrafters is constantly updating the postponement policy to reflect the most recent developments related to COVID-19. WeddingCrafters’ aim is to offer Clients as much flexibility and planning comfort as possible. Effective October 26, 2021, WeddingCrafters had implemented the following postponement policy, including some clarification and further explanation. 10. LIMITATION OF LIABILITY

10.1 In no event shall WeddingCrafters be liable for any loss of business, profits or goodwill or anticipated savings or any indirect, special or consequential loss, damage, cost or expense of any kind whatever and however caused, whether arising under contract, tort (including negligence) or otherwise (including without limitation, loss in revenue or rental from any delay). 

10.2 In any event, to the extent permitted by law, WeddingCrafters’s total liability (whether in contract, tort, including negligence, or otherwise) under or in connection with the gown rental or any other subject matter hereunder or based on any claim for indemnity or contribution shall not exceed in aggregate the total gown rental fees. 

10.3 WeddingCrafters shall not be liable for any failure to comply with the Terms & Conditions herein due to any delay, restrictions or changes required, requested, caused or otherwise arising on the part of Client. 


11. CONFIDENTIALITY

11.1 WeddingCrafters shall be entitled to list the Client as a client of WeddingCrafters and to describe and display the Service(s) and/or Product(s) provided in its corporate literature including its website, and any promotion and marketing materials.


12. PERSONAL DATA PROTECTION ACT COMPLIANCE

12.1 The Client undertakes that it is responsible for ensuring that the collection, use and disclosure of information is in compliance with the Personal Data Protection Act (“PDPA”) and the obligations the PDPA imposes. 

12.2 For the purposes of this Agreement, “Personal Data” shall mean data, whether true or not, about an individual who can be identified — from that data; or from that data and other information which an organisation has or is likely to have access. Such Personal Data shall also refer to that which is already in the possession of WeddingCrafters or that which shall be collected by WeddingCrafters in future. 

12.3 By agreeing to this Agreement, the Client hereby grants WeddingCrafters and its officers, employees and agents the right to collect the Client’s Personal Data including the Client’s picture(s), profile, likeness, videos, and/or other content and to make use of all of the Client’s Personal Data, which is held by WeddingCrafters or will be collected in the future, for the purposes of providing the relevant Services or complete such transactions which may be required by the Client from time to time; to ascertain if the Client is eligible for discounts, privileges or benefits promoted by WeddingCrafters and/or other third parties which WeddingCrafters is associated with.

12.4 In addition, the Client also grants WeddingCrafters consent, from time to time, to disclose some or all of the Client’s personal data held now or in the future by WeddingCrafters to WeddingCrafters’s employees, related corporations, agents, independent contractors and other third parties that WeddingCrafters is associated with, but only in connection with the purposes mentioned in the paragraph above. WeddingCrafters assures the Client that they are taking all measures necessary for the protection of the Personal Data. 

12.5 The Client acknowledges that Personal Data of third parties will be collected, used, and disclosed by WeddingCrafters in the course of WeddingCrafters’ provision of Services to the Client. The Client confirms that he/she/they has/have obtained consent from all of the third parties for WeddingCrafters’ collection, use, and disclosure of their Personal Data for the purposes of WeddingCrafters’ provision of Services to the Client, as well as the WeddingCrafters’ promotional and marketing purposes such as on WeddingCrafters’ website, social media or otherwise (the “Purpose”). 

12.6 The Client agrees and undertakes to notify WeddingCrafters if any of the third parties withdraw their consent to the use and disclosure of their Personal Data for the Purpose, to assist WeddingCrafters promptly with all access requests and complaints which may be received from the third parties regarding their use of their Personal Data by WeddingCrafters, and to indemnify WeddingCrafters and keep WeddingCrafters harmless against any legal action, claims, losses, damages, liabilities, penalties whatsoever which WeddingCrafters may incur or suffer as a result of the wrongful collection and use by the Client of the Personal Data and/or any breach by the Client of the Act and/or any its representations, warranties and/or undertakings contained herein.


13. FORCE MAJEURE

13.1 Notwithstanding any other provision in this Agreement, in any event, a Party shall not be liable for any delay or failure to perform or otherwise for any losses, damages, actions, proceedings, costs, claims, demands, liabilities arising from causes due to unforeseen circumstances or beyond such Party’s reasonable control, including without limitation acts of God, war, strikes, acts or regulations of government, orders of domestic or foreign courts or tribunals, military authorities and political interferences with the transactions contemplated by this Agreement, shortages of labour, fuel, energy or technological facilities. The Parties shall, in accordance with the extent to which the performance of this Agreement is affected by such an event, consult with each other and decide on whether or not to terminate or vary this Agreement. The provisions in this Clause do not apply to any obligations imposed with respect to the payment of monies under this Agreement.


14. GOVERNING LAW AND DISPUTE RESOLUTION

14.1 This Agreement shall be governed by the laws of Singapore and the Parties hereby submit to the non-exclusive jurisdiction of the courts of Singapore. 

14.2 In the event of any dispute, claim, question or disagreement arising out of or relating to this Agreement including any question regarding its existence, validity or termination or the breach of this Agreement (each a “Dispute”), no Party shall proceed to litigation or any other form of dispute resolution unless the Parties have made reasonable efforts to resolve the dispute(s) through mediation in accordance with the mediation rules of the Singapore Mediation Centre. 


15. MISCELLANEOUS

15.1 WeddingCrafters shall be entitled, with prior written consent to the Client, to assign and transfer its rights and obligations under this Agreement to such person as it deems appropriate. The Client agrees to accept the undertaking of such person in respect of the performance of any of the obligations of WeddingCrafters under this Agreement in substitution of WeddingCrafters. The Client shall not be entitled to assign or transfer any of its rights or obligations under this Agreement. 

15.2 In the event that any or any part of the provisions contained in these Terms & Conditions is determined to be invalid, unlawful or unenforceable to any extent, such provision shall be severed from the remaining provisions which shall continue to be valid and enforceable to the fullest extent permitted by law. 

15.3 A person who is not a party to these Terms & Conditions shall have no right under the Contracts (Rights of Third Parties) Act (Cap. 53B) to enforce any of its terms.
